Having opened our doors with a very small team of dedicated staff, Bott and Co has grown considerably over the years and now has over 100 employees and an annual turnover of more than £16m.
The flight delay compensation team has worked hard to establish itself at the forefront of flight compensation law, recovering over £80m since the department was established in February 2013. If we win a case, our fee is a percentage of our client’s settlement. If we don’t win, our service is completely free.

Our Partners
David Bott
David Bott is the Senior Partner at Bott and Co and a member of the Association of Personal Injury Lawyers (APIL), having also served as the APIL President 2011-2012. He established Bott and Co with Managing Partner Paul Hinchliffe and Finance Director Gary Froggatt.
David has been heavily involved with Road Traffic Accident claims Portal via the Project Steering Group, and he is now a Director of Portal Co. From 2008-2010 he was the APIL representative on the Law Society Council and a member of the Law Society’s Civil Justice Committee (2008-2010).
His areas of expertise are personal injury, road traffic and cycling accident claims and flight delay compensation. Speaking about his passion for righting wrongs, he says, “At Bott and Co the customer experience is at the core of what we do. Paul Hinchliffe
Paul Hinchliffe is the Managing Partner at Bott and Co. His areas of expertise are within HR strategy, corporate strategy, learning and development, technology and innovation in the law and operational processes.
Passionate about technology, Paul oversees the practice’s substantial investment in leading-edge IT systems and focus on quality standards. He says, “I am proud of what we have achieved over the last five years in flight delay claims, setting up the team from scratch. We won the leading two cases in the country at the Court of Appeal in May 2014 and each of those decisions impacts on billions of pounds worth of claims for passengers.
Gary Froggatt
Gary Froggatt is the Finance Partner at Bott and Co and has decades of experience that enables him to provide financial analysis and guidance to the Board’s Finance and Accounting strategy. Amongst other tasks, he is responsible for ensuring the Finance team provides an efficient and effective service to the business.
He brings strong strategic vision to the role and a commitment to operational efficiency, execution and excellence. Gary is a well organised financial leader with strong results orientation, adopting a “can do” approach to business challenges in his day to day working life.
He says, “Everything the business does is reflected in its financial information and working in an ever-changing legal sector, for me what remains key is to ensure the firm’s financial systems are robust, compliant and support activities and ongoing growth.”
Significant Cases We Have Won
Huzar v Jet2
This flight delay compensation case weighed in on the question of whether a technical issue constitutes an “extraordinary circumstance”, and is probably the most significant case in UK legal history regarding flight delays.
Bott and Co and Jet2 disagreed on whether a technical problem with the airline counts as an “extraordinary circumstance” – an airline’s only legitimate defence in paying out on claims. The airline believed that it did constitute as extraordinary – but Bott and Co successfully argued that this situation isn’t out of the ordinary and inherent in the normal operation of an airline.
The case was a resounding success for passenger rights, as it meant that a technical fault can be claimable, opening the opportunity for billions of pounds for delayed air passengers around the world.
Originally Mr Huzar lost his claim in court, so he came to Bott and Co to represent him at the appeal level. Bott and Co won the appeal case, resulting in Jet2 appealing the decision. After the case went to the Court of Appeal in London, the airline lost this hearing and requested permission to appeal that decision, which the Supreme Court refused, quashing any further action by Jet2.
Dawson v Thomson
Another consumer win for millions of passengers was Dawson v Thomson. The case centred on the “limitation period” i.e. how long a passenger can claim flight delay compensation for after the flight under EU Regulation 261/2004.
Bott and Co argued it was six years as stated in EU Regulation 261, but Thomson disagreed, arguing that it should be two years based on the Montreal Convention – a set of rules that deal with other travel-related claims.
Thomson initially argued that the delay was due to extraordinary circumstances but then changed their argument to the limitation point and stated that Mr Dawson had not brought his claim to court on time.
Mr Dawson won, which resulted in the airline taking the case to the Court of Appeal, but the outcome decided that Bott and Co was victorious and passengers could continue to claim for delays up to six years old.
