Flight compensation amounts are set by EU Regulation 261/2004. How much compensation you can claim will depend on how many hours your flight was delayed and the flight distance.

The compensation amounts for flight delays and cancellations are fixed and unrelated to the ticket cost or the class of the fare you booked. The maximum amount you can claim is £520 per passenger.

How Many Years After My Flight Can I Claim For Compensation?

You can start your flight delay claim up to 6 years from the scheduled flight date, as the statute of limitation in the UK is 6 years.

However, once court proceedings are issued against an airline, this effectively ‘stops the clock’ on the 6-year limitation period, so it doesn’t matter how long the legal process takes after that point as long as you follow the timeframes set by the courts for each stage of the process.

Can I Claim For Expenses From My Flight Delay?

Under EU 261, airlines are legally obliged to provide “care and assistance” to passengers after a certain length of delay. This includes covering “reasonable” expenses you may incur.

The airline should inform you of this while you are travelling and cover all these costs at the time. However, we see cases where passengers have had to use their own money to buy food and drink or get taxis to and from the airports.

For delays over two hours, or three hours in the case of long-haul flights, the airline must provide passengers with the following:

  • Free meals and refreshments
  • Two phone calls or emails
  • Free hotel accommodation and transport to the hotel if the delay is overnight

If the airline does not offer any of the above, you should purchase what you need and keep all your receipts, as you could claim it back later directly from the airline.
