Bott and Co Solicitors secured £6,000 for a fashion retail assistant who was left with moderate pain for two years after she was involved in a road traffic accident on 4th October 2011.
The claimant, Miss R sustained whiplash to the back of the neck, right shoulder and thoracic spine when she was stationary in her vehicle at a set of traffic lights in West Yorkshire.
As she waited to continue her journey, a vehicle being driven by the defendant collided with the rear of the claimant’s car. It was argued that the defendant acted negligently in that he failed to stop, something he admitted when the case went to court.
The defendant argued that he tried to manoeuvre to the middle lane, however as he attempted to steer left he noticed a Range Rover travelling at speed thus he immediately steered right in order to avoid colliding with the Range Rover. It was when he steered right that he collided with the rear of the claimant’s car at low speed.
As a result of her injuries, Miss R was forced to have time off work whilst she recuperated; therefore she suffered loss of income as a result of the collision. Even when she returned to her day job, the claimant struggled and had to take extra care. The pain in her spine and shoulders meant she was unable to lift – which her job as a retail assistant required her to do.
As a result of Bott and Co’s work, Miss S received £6,000 which was agreed by both parties following a Part 36 offer.
Prior to the collision Miss R led an active social lifestyle; however, she was restricted for two weeks following the collision. During this time she was unable to socialise with family and friends and was limited in what she could do at home.
Miss R described how she was ‘jolted forwards’ when the defendant collided with her, with almost immediate physical and psychological injuries.
After Miss R approached Bott and Co, the team quickly acted to recover compensation for the injuries and loss of income the claimant suffered from.
The defence argued that the claimant couldn’t be injured at a low speed, even though the claimant herself spent £800 on chiropractic treatment to ease her back pain.
As a result of Bott and Co’s work, Miss S received £6,000 which was agreed by both parties following a Part 36 offer.
